Opulent Home Concierge LLC ("Opulent Home Concierge," "we," "us," or "our") provides a software application and related services that allow customers to input information about their homes and request, schedule, and manage services delivered by our network of third-party service providers (collectively, the "Services"). 2. Definitions

"Application" means our websites, web or mobile apps, and related online Services that link to this Privacy Policy.

"Personal information" or "personal data" means information that identifies, relates to, describes, or can reasonably be linked with an identified or identifiable individual. Examples include name, contact details, identifiers, and device information.

"Sensitive personal information" means certain categories of personal information defined by applicable law (for example, precise geolocation, account login credentials, government ID numbers). We do not require sensitive personal information to use the Application, but you may choose to provide certain details (for example, gate or lockbox codes) to facilitate services.

"Providers" means independent third-party businesses that perform the services you request through the Application.

"Service providers" (or "processors/contractors") means vendors we engage to process information on our behalf under contract (for example, hosting, analytics, messaging, or payment processing vendors).

3. How the Application Works (Overview)

The Application enables you to create an account, add information about your property and preferences, and request or schedule services (for example, cleaning, landscaping, maintenance, repairs). We receive and process your requests, match them with Providers, coordinate scheduling, and share the minimum necessary information so Providers can perform the requested work. You can opt in or opt out of receiving marketing communications and you can choose whether to receive system notifications by email and text message (SMS/MMS). Transactional notices necessary to deliver the Services may still be sent via the channels you enable for your account.

4. Categories of Personal Information We Collect

The information we collect depends on how you interact with the Application and the choices you make.

A. Information you provide directly

  • Account and Identity: name, phone number, email address, password or credential data (stored in hashed form), profile photo.

  • Property and Household Details: service addresses, access instructions you choose to provide (for example, gate or lockbox codes), room details, photos or videos, inventory of fixtures or appliances (including model or serial numbers you provide), notes and preferences.

  • Service Requests and Transactions: requested services, scheduling preferences, budgets or quotes, worksite notes, before/after photos, approvals, signatures, ratings or reviews, communications with Providers, and transaction records.

  • Communications and Preferences: message content, feedback, surveys, customer support inquiries, marketing and notification opt-in/opt-out settings, consent timestamps and records.

  • Payment Information: we use third-party payment processors to collect payment details. We do not store full credit or debit card numbers. Our processor provides us tokenized references and limited details (for example, last 4 digits and expiration month/year) for receipts, dispute handling, and fraud prevention.

B. Information we collect automatically

  • Device and Usage Data: IP address, device identifiers, device type, operating system, browser type, language settings, referring and exit URLs, pages or screens viewed, links clicked, time on site, session duration, and in-app events.

  • Log and Diagnostic Data: timestamps, authentication logs, error logs, and performance metrics.

  • Cookies and Similar Technologies: cookies, pixels, SDKs, and local storage used for authentication, security, session continuity, analytics, remembering preferences, and (if enabled) marketing measurement. See Section 11.

C. Information from third parties

  • Providers and Partners: limited information related to scheduling, job status, time and location windows, photos of work performed, invoices, and fulfillment outcomes.

  • Payment and Fraud Prevention: payment processors, chargeback and fraud-screening services.

  • Analytics and Measurement: analytics platforms provide aggregated or pseudonymous data about usage, performance, and campaign measurement.

  • Public and Commercial Sources: address validation, geocoding, or property records where available to improve accuracy and scheduling.

We do not intentionally collect sensitive personal information unless you choose to provide it. If you provide access instructions or other sensitive details, we use them only as needed to provide the Services, protect customers and Providers, and comply with law. Do not include sensitive information in public review fields.

5. Purposes for Using Personal Information

We use personal information for the following purposes:

  • Provide and Improve the Services: create and manage accounts, authenticate users, operate the Application, process service requests, coordinate with Providers, process payments and refunds, and improve features and usability.

  • Scheduling and Communications: send account verification codes, password resets, appointment confirmations and reminders, schedule changes, service status and completion notices, follow-ups, and receipts.

  • Customer Support: respond to inquiries, troubleshoot issues, and provide technical assistance.

  • Safety, Security, and Fraud Prevention: monitor, detect, investigate, and prevent fraud, abuse, spam, or unauthorized access; secure accounts and our infrastructure; and protect the rights, safety, and property of users, Providers, and the public.

  • Research, Analytics, and Product Development: analyze usage and performance, test features, and develop new offerings.

  • Marketing and Promotions: send promotional messages only if you opt in; personalize content where permitted; measure campaign performance.

  • Legal and Compliance: comply with laws, regulations, lawful requests, or legal processes; enforce our terms and policies; and resolve disputes.

Where required by law (for example, EEA/UK), our legal bases include performance of a contract, legitimate interests (for example, service improvement and security), consent (for example, marketing messages and certain cookies), and compliance with legal obligations.

6. Text Messaging Terms and Conditions (Toll-Free Program)

Transactional SMS/MMS messages related to your account and service requests, and, if you separately opt in, recurring marketing messages.

Opt-in methods: enable SMS in your account settings; check a consent box. Consent is not a condition of purchase. By opting in, you authorize us to use to send messages to the mobile number you provide.

Marketing messages are recurring until you opt out.

Opt-out: you can cancel at any time. Communications can be opted out via request or by opting out in the settings section of your user profile in the Application.

Costs and carriers: message and data rates may apply. Message delivery may be limited by your carrier or device. Carriers are not liable for delayed or undelivered messages.

Data collected via SMS: we may collect your phone number, carrier, message content, timestamps, delivery and read receipts (where available), and interaction logs. We use this information to provide the program, maintain consent records, troubleshoot, prevent abuse, and comply with laws and carrier requirements.

Eligibility and geographic scope: you must be the account holder or have the account holder’s permission to enroll the mobile number. The program is intended for U.S. users on participating carriers.

Changes: we may modify or terminate the program at any time. We will provide notice where required by law.

7. How We Disclose Personal Information

We disclose personal information in the following circumstances:

  • Service providers (processors/contractors): vendors that host, maintain, and support the Application; provide cloud, storage, or security services; deliver SMS/email and in-app messages; provide analytics or measurement; process payments; provide mapping or geocoding; and deliver customer support tools. These parties may access personal information only to perform services for us under appropriate contractual safeguards.

  • Third-party Providers you request: to schedule and fulfill your service requests, we share the minimum necessary information with Providers (for example, name, service address, contact phone, scheduled time windows, requested services, and relevant photos or notes). Providers are independent businesses and have their own privacy practices.

  • Business transfers: in connection with a merger, acquisition, financing, or sale of all or part of our business or assets, personal information may be transferred under appropriate confidentiality protections.

  • Legal compliance and safety: to comply with laws, lawful requests, or legal processes; to protect the rights, property, and safety of you, us, our users, or the public; and to detect, prevent, or address fraud, security, or technical issues.

  • With your consent or direction: when you authorize us to share.

We do not sell personal information and do not share personal information for cross-context behavioral advertising as defined by certain U.S. state privacy laws.

9. User-Generated Content and Reviews

If you submit reviews, photos, or other content, that content may be visible to others in the Application or in communications with Providers. Do not include sensitive personal information in user-generated content or reviews. We may remove content that violates our terms or applicable law.

9. Property Access Data and Photos

If you choose to store property access instructions (for example, gate or lockbox codes) or upload photos or videos of your property, we treat this information as highly sensitive and restrict access to personnel and Providers on a need-to-know basis. Consider updating or rotating access codes periodically. Do not share sensitive instructions in public or review fields.

10. Data Retention

We retain personal information for as long as necessary to provide the Services, comply with legal obligations, resolve disputes, enforce agreements, and for other legitimate business purposes.

Illustrative examples (actual periods may vary):

  • Account profile information: retained while your account is active and for a reasonable period thereafter, or as required by law.

  • Service records, work orders, invoices, and receipts: retained for at least the applicable statute of limitations or tax recordkeeping period.

  • Consent and opt-in/opt-out records: retained for the period required by law and carrier rules.

  • Diagnostic logs and security data: retained for operational security needs and legal compliance.

When personal information is no longer needed, we delete it or de-identify it, subject to backup and archival retention and technical limitations.

11. Cookies, Analytics, and Online Tracking

We and our partners use cookies and similar technologies to authenticate users, keep sessions active, remember preferences, conduct analytics, and, if enabled, measure marketing. You can manage cookies via your browser settings and, where available, through in-product controls. Blocking cookies may impact some features.

Do Not Track and Global Privacy Control: at this time, we do not respond to browser Do Not Track signals. If we engage in "selling" or "sharing" personal information in the future under applicable law, we will honor relevant opt-out signals as required. Currently, we do not sell or share personal information for cross-context behavioral advertising.

12. Your Choices

  • Account information: you can review and update certain account details in the Application or by contacting us by phone or mail.

  • Marketing communications: you can opt out of marketing emails using unsubscribe links and opt out of marketing texts by following the instructions in Section 6. You will continue to receive non-marketing communications necessary to provide the Services (for example, appointment updates) unless you disable that channel entirely.

  • Device and app permissions: you may disable certain device permissions (for example, camera, photos, notifications) via your device settings. Some features may not function without these permissions.

13. U.S. State Privacy Rights

Depending on your state of residence (for example, CA, CO, CT, UT, VA), you may have some or all of the following rights, subject to legal exceptions: access (know), correction, deletion, portability, and the right to limit the use or disclosure of sensitive personal information. You may also have the right to appeal our decision regarding a request.

How to submit a request: call us or mail a written request to the address in Section 1 with "Privacy Request" in the subject line. Please include your name, the phone number associated with your account, and a description of your request. We may provide additional instructions to verify your identity. If you use an authorized agent, we may require proof of authorization and may ask you to verify your identity directly with us.

Verification: we will verify your request using information reasonably related to your account (for example, by contacting you at your registered phone number). We may deny requests if we cannot verify your identity or if legal exceptions apply.

Non-discrimination: we will not discriminate against you for exercising your privacy rights.

Selling and sharing: we do not sell personal information and do not share personal information for cross-context behavioral advertising. We do not use or disclose sensitive personal information for purposes that require a right to limit under the California Consumer Privacy Act as amended by the CPRA.

Notice at collection for California residents: categories we collect may include identifiers (for example, name, phone, email), customer records (for example, service address), commercial information (for example, service histories), internet or electronic activity (for example, device and usage data), geolocation (approximate based on IP or scheduling windows), audio/visual information (for example, photos you upload), and inferences (limited, for example, preferences derived from your settings). We collect these categories to operate the Application, provide and improve Services, secure accounts, process transactions, and, with consent, send marketing communications. We disclose these categories as described in Section 7. We do not sell or share these categories under California law.

Financial incentives: we do not offer financial incentives in exchange for personal information.

14. EEA/UK Disclosures (GDPR)

Where the GDPR or UK GDPR applies, Opulent Home Concierge LLC is the controller of personal data processed through the Application.

Legal bases: contract performance; legitimate interests (for example, security and improvement); consent (for example, marketing messages and certain cookies); and legal obligation.

Your rights: access, rectification, erasure, restriction, portability, and objection. You may withdraw consent at any time without affecting prior processing. You also have the right to lodge a complaint with your local supervisory authority.

International transfers: we may transfer personal data to countries without equivalent data protection (for example, the United States). Where required, we use appropriate safeguards, such as the European Commission’s Standard Contractual Clauses.

15. Data Security

We implement administrative, technical, and physical safeguards designed to protect personal information, including access controls, encryption in transit and at rest where appropriate, network monitoring, logging, and secure development practices. No method of transmission or storage is completely secure. You are responsible for using strong, unique passwords and for keeping your credentials confidential.

16. Third-Party Sites and Services

The Application may contain links to third-party websites or services. We are not responsible for the privacy practices of those third parties. Review their privacy policies to understand their practices.

17. Children’s Privacy

The Application is not directed to children under 18, and we do not knowingly collect personal information from children under 18. If we learn that a child under 18 has provided personal information, we will delete it. Parents or guardians who believe their child has provided personal information should contact us by phone or mail using the details in Section 1.

18. Changes to This Privacy Policy

We may update this Privacy Policy from time to time. We will post the updated version with a new Effective Date and, where required, provide additional notice (for example, in-app notifications).
